Terms & Conditions

By downloading or using the app, these terms will automatically apply to you – you should ensure that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to Launchround Inc.

Launchround Inc. is committed to ensuring the app is as helpful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it clear to you exactly what you’re paying for.

The Pencil Bible app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We, therefore, recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Pencil Bible app won’t work properly or at all.

The app does use third-party services that declare their own Terms and Conditions.

You should be aware that there are certain things that Launchround Inc. will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but Launchround Inc. cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, Launchround Inc. cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail of the Service, Launchround Inc. cannot accept responsibility.

With respect to Pencil Bible Inc’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Launchround Inc. accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on iOS – the requirements for the system(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Launchround Inc. does not promise that it will always update the app so that it is relevant to you and/or works with the iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Scope

The Service is a Bible app that allows annotations and many other features. We may also offer other related services, some of which may be provided to you with the help of our third-party partners (Third Party Providers).

Account Basics

If you sign up for a user account, make sure to give us accurate information and not share your account or password with anyone else!

In order to use some of the features provided by the Service, you may be required to sign up for an account and select a password and username (your “PencilBible User ID”). You promise to provide us with accurate, complete, and updated registration information about yourself. You may not select as your PencilBible User ID a name that you don’t have the right to use, or another person’s name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission.

You will not share your account or password with anyone, and you must protect the security of your account and your password. You’re responsible for any activity associated with your account.

User Generated Annotations

(This should be pretty self-explanatory! In the unlikely event that your annotations (notes, writings, illustrations, doodles, images, highlights, etc.) are lost we could not be held responsible.)

The Pencil Bible App allows the creation of user content (user data) in the form of annotations and other forms of creative input. Launchround Inc. or its holding company, employee’s, directors, or any other associated company does not in any circumstance except the loss of the user-created content in any form and can not be held liable or responsible for the loss of this content or user-created data or the third parties who store this data.

Jurisdictional Issues

The Service is controlled or operated (or both) from the United States, and is not intended to subject Launchround Inc. to any non-U.S. jurisdiction or law. The Service may not be appropriate or available for use in some non-U.S. jurisdictions. Any use of the Service is at your own risk, and you must comply with all applicable laws, rules, and regulations in doing so. We may limit the Service’s availability at any time, in whole or in part, to any person, geographic area, or jurisdiction that we choose.

Launchround Inc. takes the privacy of its users very seriously. We strongly urge you to review our Privacy Policy.

Pricing & Features

Fees, Transactions, Subscriptions, and Promotions

(This should be pretty self-explanatory! If you buy something from us, we’ll charge your card accordingly.)

Pencil Bible may make available the ability to purchase products or services or otherwise purchase access to certain subscriptions through the Service (each a “Transaction”). If you wish to make a Transaction, you may be asked to supply certain relevant information, such as your credit card number and its expiration date, and your billing address. You represent and warrant that you have the right to use any credit card that you submit in connection with a Transaction. By submitting such information, you grant to us the right to provide such information to third parties for purposes of facilitating Transactions. Verification of information may be required prior to the acknowledgment or completion of any Transaction. Pencil Bible may need to verify your payment information before completing your purchase. You will ensure that your payment details (such as your credit card number) are accurate and up-to-date at all times.

Also, by purchasing products and/or services via the Services, you promise to use such products and services lawfully.

If you purchase a subscription to a product or service, or if you start a free trial for such a subscription, your subscription will renew automatically at the regular subscription price and at the frequency stated when you made the purchase or began the free trial unless you are otherwise notified in writing. Unless you set a subscription to stop automatically renewing prior to its renewal date, or cancel a free trial before it ends, each in the manner specified by us, you authorize us (without further notice to you, unless otherwise required by applicable laws) to charge the payment method you have provided to us in the amount of the then-current subscription fees and any applicable taxes, on a monthly basis or at any other frequency specified by us and agreed to by you. If Pencil Bible cannot charge your payment method for any reason, such as an expired payment method information or insufficient funds, you remain responsible for any uncollected amounts, and Launchround Inc. may initiate additional attempts to charge the payment method as you may update your payment method information. Launchround Inc. may terminate a subscription at any time, or change the terms of subscriptions. If Launchround Inc. terminates a subscription, you will receive a prorated refund if applicable.

Launchround Inc. reserves the right, including without prior notice, to limit the available quantity of or discontinue any product or service; to impose conditions on your use of any coupon, discount, or similar promotion; to bar any user from making any purchase of our products or services, and to refuse to provide you with any product or service. Refunds and exchanges will be subject to our applicable refund and exchange policies. You agree to pay all charges incurred by you or on your behalf through the Service, at the prices in effect when such charges are incurred, including all shipping and handling charges. In addition, you are responsible for any taxes that apply to your purchases. While it is our practice to confirm orders by e-mail, the receipt of an e-mail order confirmation does not constitute our acceptance of an order or our confirmation of an offer to sell a product or service.

Any sweepstakes, contests, raffles, surveys, games, coupons, rebates, or similar promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from this Agreement. If you participate in any Promotions, please review the applicable rules as well as the Privacy Policy. If the rules for a Promotion conflict with this Agreement, the Promotion rules will govern with respect to such Promotion to the extent of such conflict.

*Premium Bibles get added on an ongoing basis and are purchased separately.

Prices may differ based on your location. Purchases are completed inside the app. Available features may differ between platforms (as we continue to iterate). We reserve the right to change pricing & terms at any time.

The annual subscriptions begin with a 14-day free trial. After the 14-day free trial, your Apple ID account will be charged and renewed automatically unless cancelled at least 24 hours before the end of the trial or subscription period. You can manage and cancel your subscription by going to your account settings on the App Store after purchase.

Other Legal Items

Your Content & Conduct

Our Service allows you and other users to post content. Although your content is only visible to you, you are responsible for the content that you make available to the Service, including its legality, reliability, and appropriateness.

Anything you post, upload, share, store, or otherwise provide through the Services is your “User Submission.” Some User Submissions are viewable by other users. In order to display your User Submissions on the Services, and to allow other users to enjoy them (where applicable), you grant us the following rights in those User Submissions. For all User Submissions, you hereby grant Launchround Inc. a license to translate, modify (for technical purposes, for example making sure your content is viewable on a tablet as well as a computer), reproduce, display, and otherwise act with respect to such User Submissions, in each case to enable us to operate and provide the Services to you. This is a license only – your ownership in User Submissions is not affected.

If you share a User Submission publicly on the Services and/or in a manner that more than just you can view (a “Public User Submission”), then you grant Launchround Inc. the licenses above, as well as a license to display, perform, and distribute your Public User Submission for the purpose of making that Public User Submission accessible to all the applicable Pencil Bible users and providing the Services necessary to do so.

Pencil Bible has no control over and is not responsible for any use or misuse (including any distribution) by any third party of your User Submissions. IF YOU CHOOSE TO MAKE ANY OF YOUR PERSONALLY IDENTIFIABLE OR OTHER INFORMATION PUBLICLY AVAILABLE THROUGH THE SERVICES, YOU DO SO AT YOUR OWN RISK.

You promise that any information you provide in connection with the Services is and will remain accurate and complete and that you will maintain and update such information as needed.

You can remove the content that you posted by deleting it. Once you delete your content, it will not appear on the Service, but copies of your deleted content may remain in our system or backups for some period of time. We will retain web server access logs for a maximum of 30 days and then delete them.

Pencil Bible Materials

We put a lot of effort into creating the Service including, the logo and all designs, text, graphics, pictures, information, and other content (excluding your content). This property is owned by us or our licensors and it is protected by the U.S. and international copyright laws. We grant you the right to use it.

However, unless we expressly state otherwise, your rights do not include: (i) publicly performing or publicly displaying the Service; (ii) modifying or otherwise making any derivative uses of the Service or any portion thereof; (iii) using any data mining, robots or similar data gathering or extraction methods; (iv) downloading (other than page caching) of any portion of the Service or any information contained therein; (v) reverse engineering or accessing the Service in order to build a competitive product or service; or (vi) using the Service other than for its intended purposes. If you do any of this stuff, we may terminate your use of the Service.

Hyperlinks and Third-Party Content

You may create a hyperlink to the Service. But, you may not use, frame, or utilize framing techniques to enclose any of our trademarks, logos, or other proprietary information without our express written consent.

Launchround Inc. makes no claim or representation regarding and accepts no responsibility for third-party websites accessible by hyperlink from the Service or websites linking to the Service. When you leave the Service, you should be aware that these Terms and our policies no longer govern.

If there is any content on the Service from you and others, we don't review, verify or authenticate it, and it may include inaccuracies or false information. We make no representations, warranties, or guarantees relating to the quality, suitability, truth, accuracy, or completeness of any content contained in the Service. You acknowledge sole responsibility for and assume all risk arising from your use of or reliance on any content.

Unavoidable Legal Stuff

THE SERVICE AND ANY OTHER SERVICE AND CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE ARE PROVIDED TO YOU ON AN AS-IS OR AS AVAILABLE BASIS WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND. WE DISCLAIM ANY AND ALL WARRANTIES AND REPRESENTATIONS (EXPRESS OR IMPLIED, ORAL OR WRITTEN) WITH RESPECT TO THE SERVICE AND CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE WHETHER ALLEGED TO ARISE BY OPERATION OF LAW, BY REASON OF CUSTOM OR USAGE IN THE TRADE, BY COURSE OF DEALING OR OTHERWISE.

IN NO EVENT WILL Launchround INC. (AND DIRECTORS, EMPLOYEES, DEVELOPERS, AND ASSOCIATED COMPANIES) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR ANY OTHER SERVICE AND/OR CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR ARE AWARE OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CAUSES OF ACTION AND UNDER ALL THEORIES OF LIABILITY WILL BE LIMITED TO THE AMOUNT YOU PAID TO PENCIL BIBLE. THIS SECTION WILL BE GIVEN FULL EFFECT EVEN IF ANY REMEDY SPECIFIED IN THIS AGREEMENT IS DEEMED TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

You agree to defend, indemnify and hold us harmless from and against any and all costs, damages, liabilities, and expenses (including attorneys' fees, costs, penalties, interest, and disbursements) we incur in relation to, arising from, or for the purpose of avoiding, any claim or demand from a third party relating to your use of the Service or the use of the Service by any person using your account, including any claim that your use of the Service violates any applicable law or regulation, or the rights of any third party, and/or your violation of these Terms.

Indemnity

You shall indemnify and hold harmless Launchround Inc., its affiliates, its partners, and each of its, and its affiliates, and its partners, employees, contractors, directors, suppliers, and representatives from all liabilities, losses, damages, claims, and expenses, including reasonable attorneys' fees, that arise from or in connection with (i) your use of, or activities in connection with, the Services (including all User Submissions), (ii) your breach of this Agreement, or (iii) your negligence, willful misconduct, or violation of any laws or regulations or third party rights. Launchround Inc. reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully assist and cooperate with Launchround Inc. in asserting any available defenses.

Intellectual Property

We take intellectual property rights seriously. In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and, at our sole discretion, access to the service for users who are deemed to be repeat infringers.

The validity of these Terms and the rights, obligations, and relations of the parties under these Terms will be construed and determined under and in accordance with the laws of the United States, without regard to conflicts of law principles.

Jurisdiction

You expressly agree that exclusive jurisdiction for any dispute with the Service or relating to your use of it, resides in the courts of California and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of California located in San Mateo County in connection with any such dispute including any claim involving Service. You further agree that you and Service will not commence against the other a class action, class arbitration, or other representative action or proceeding.

If you breach any of these Terms, we have the right to suspend or disable your access to or use of the Service.

Termination

Though we’re sad to see you go, you are free to stop using the Services at any time. You can cancel your Pencil Bible account by using the account cancellation features available in the App. In addition, Launchround Inc. may terminate or suspend your access to the Service at any time, with or without cause. Upon termination, you will no longer access (or attempt to access) the Service.

If you terminate this Agreement, or Pencil Bible terminates for your breach of this Agreement, you will not be refunded any of the amounts you have paid Pencil Bible. Such amounts will be forfeited upon termination.

In the event of any termination of this Agreement, you are responsible for payment of all Service charges up through the date of termination.

All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, all warranty disclaimers, limitations of liability, and disputes resolutions provisions.

Dispute Resolution

If a dispute ever arises between us and you (which hopefully will never ever be the case!), here is how it will be dealt with.

Let's Try To Work It Out. Ideally, if you have any concerns or complaints against Launchround Inc., Launchround Inc. would like to resolve the issue without resorting to a formal court or arbitration proceedings. Therefore, before filing a claim against Pencil Bible, you agree to try to resolve the dispute informally by contacting Pencil Bible. Pencil Bible will attempt to resolve the dispute informally (and will contact you via email if you’ve provided us the means to do so).

YOU UNDERSTAND AND AGREE THAT BY ENTERING INTO THESE TERMS, YOU AND Launchround Inc. ARE EACH WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

Entire Agreement

These Terms constitute the entire agreement between you and the Launchround Inc. regarding the use of the Service, superseding any prior agreements between you and Quiet Pupil relating to your use of the Service.

Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
