    These Terms of Service (“Terms”) govern your access to and use of Pencil Bible, including the Pencil Bible mobile applications, websites, features, content, subscriptions, and related services (collectively, the “Service”).

    The Service is provided by Launchround Inc. (“Launchround,” “Pencil Bible,” “we,” “us,” or “our”).

    By downloading, accessing, purchasing, subscribing to, or using Pencil Bible, you agree to these Terms. If you do not agree to these Terms, you must not use the Service.

    If you are not legally old enough to enter into a binding agreement in your country or region, a parent or legal guardian must review and agree to these Terms on your behalf.

    1. About Pencil Bible

    Pencil Bible is a Bible reading, study, journaling, annotation, and note-taking application that allows users to read Scripture and create annotations and other content.

    Depending on your device and platform, features may include handwriting, drawing, highlighting, typed text, images, stickers, bookmarks, Bible search, custom layouts, syncing, cloud storage, and other Bible study or creative tools.

    Pencil Bible is available on supported Apple and Android devices. Features, functionality, Bible translations, subscriptions, and availability may differ between operating systems, devices, countries, and versions of the Service.

    We may add, change, remove, limit, or improve features at any time.

    2. Your Account

    Some features of Pencil Bible may require you to create an account.

    You agree to provide accurate and current information when creating or maintaining your account. You are responsible for maintaining the security of your login credentials and for activity that occurs through your account.

    You may not:

    • impersonate another person;
    • use an account that you do not have permission to use;
    • share access in a way that violates these Terms;
    • attempt to gain unauthorized access to another user's account; or
    • sell or transfer your account without our written permission.

    You should notify us promptly if you believe that your account has been compromised.

    3. License to Use Pencil Bible

    Subject to these Terms, Launchround grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use Pencil Bible for your personal and lawful use.

    You may not, except where permitted by applicable law:

    • copy, modify, distribute, sell, lease, or sublicense the Service;
    • reverse engineer or attempt to extract the source code of the Service;
    • bypass security, subscription, payment, or access restrictions;
    • use automated systems, scraping tools, robots, or similar technology to extract content from the Service;
    • use the Service to create a competing product or service;
    • misuse our trademarks, branding, designs, or intellectual property; or
    • use the Service for unlawful purposes.

    All rights not expressly granted to you remain reserved by Launchround and its licensors.

    4. Bible Translations and Third-Party Content

    Pencil Bible may provide access to Bible translations and other content owned or licensed by third parties.

    The availability of specific translations may change due to licensing arrangements, publisher requirements, geographic restrictions, platform limitations, or other circumstances outside our control.

    Some translations may be available without additional charge, while others may require a separate purchase or other form of access. Any applicable price or access requirement will be displayed before purchase.

    Your use of third-party Bible translations and other licensed material may also be subject to additional copyright notices, license terms, or restrictions from the applicable publisher or rights holder.

    Launchround does not claim ownership of Bible translations or other third-party content unless expressly stated.

    5. Your Annotations and Content

    Pencil Bible allows you to create and store content including notes, handwriting, drawings, highlights, images, stickers, typed text, layouts, bookmarks, and other material (“User Content”).

    You retain ownership of your User Content.

    You grant Launchround a limited license to host, store, process, reproduce, modify, and transmit your User Content only as reasonably necessary to operate, maintain, synchronize, improve, and provide the Service to you.

    If Pencil Bible introduces features that allow you to intentionally share content publicly or with other users, additional permissions may be necessary to display and distribute that content.

    You are responsible for ensuring that your User Content does not violate applicable law or the rights of another person.

    6. Data Loss, Storage, and Backups

    We understand that your annotations and notes may be personally important to you. However, no digital storage or synchronization system can be guaranteed to operate without interruption or data loss.

    Synchronization, backup, and storage may depend on your device, internet connection, operating system, third-party cloud services, account status, available storage, and other technical factors outside our control.

    You are responsible for taking reasonable steps to protect important information and maintaining independent copies or backups where possible.

    To the maximum extent permitted by applicable law, Launchround and its directors, employees, contractors, affiliates, service providers, and partners will not be liable for the accidental loss, corruption, deletion, failed synchronization, or inability to recover User Content.

    7. Privacy

    Your privacy is important to us.

    Our collection, use, storage, and processing of personal information is governed by our Privacy Policy, which forms part of your use of the Service.

    By using Pencil Bible, you acknowledge that information may be processed as described in our Privacy Policy.

    8. Third-Party Services

    Pencil Bible may rely on third-party services to provide functionality such as:

    • app distribution;
    • payments and subscriptions;
    • cloud storage and synchronization;
    • authentication;
    • analytics;
    • crash reporting; and
    • other technical infrastructure.

    These third-party services may have their own terms and privacy policies.

    Launchround is not responsible for the availability, performance, security, or conduct of third-party services that we do not control.

    9. Free Access and Premium Features

    Pencil Bible may provide certain features without charge and may limit other features to users with a paid subscription, one-time purchase, promotional offer, or other qualifying access.

    The features included in free and paid access may change over time.

    We may introduce, remove, modify, or reorganize subscription plans, pricing options, features, trials, promotions, and one-time purchases.

    Features may also differ between Apple and Android devices.

    Any applicable features, pricing, billing period, trial period, and other material purchase information will be displayed to you before you complete a purchase.

    10. Subscriptions and Pricing

    Pencil Bible may offer recurring subscription plans, including weekly, monthly, annual, or other subscription periods.

    Pencil Bible may also offer one-time purchases or lifetime access products on certain platforms.

    The exact price you pay is the price displayed to you through the applicable App Store, Google Play store, or other authorized purchase method at the time you complete your purchase.

    Prices may vary depending on:

    • your country or region;
    • your currency;
    • applicable taxes;
    • your device or platform;
    • promotional offers;
    • legacy subscription plans; and
    • pricing changes made over time.

    We reserve the right to change our prices and subscription offerings.

    Changes to the price of an existing recurring subscription will be handled in accordance with applicable law and the policies of the platform through which you purchased your subscription.

    11. 14-Day Free Trial

    Eligible new users may be offered a 14-day free trial for qualifying Pencil Bible subscription plans.

    The availability and eligibility requirements for a free trial may vary by subscription, platform, country, account history, or promotional offer.

    Unless otherwise stated at the time you begin the trial, your subscription will automatically convert into a paid subscription at the end of the 14-day trial period.

    The subscription price and billing frequency that will apply after the trial will be displayed to you before you confirm the subscription.

    To avoid being charged, you must cancel the subscription before the free trial ends using the subscription management tools provided by the platform through which you subscribed.

    Deleting Pencil Bible from your device does not automatically cancel an active subscription.

    Where permitted by the applicable platform, free trials may be limited to one trial per user, account, subscription, or household.

    12. Automatic Renewal and Cancellation

    Recurring subscriptions automatically renew unless they are cancelled in accordance with the rules of the platform through which the subscription was purchased.

    If you subscribe through Apple, your subscription is managed through your Apple account.

    If you subscribe through Google Play, your subscription is managed through your Google Play account.

    You are responsible for cancelling your subscription through the appropriate platform before the applicable renewal or trial deadline if you do not wish to continue your subscription.

    After cancellation, you will generally retain access to the applicable subscription features until the end of your current paid billing period, subject to the policies of the applicable platform.

    We do not directly control the processing times, billing systems, cancellation systems, or subscription management tools operated by Apple, Google, or other third-party payment providers.

    13. Payments and Refunds

    Purchases made through the Apple App Store or Google Play are processed by the applicable platform and are subject to that platform's payment and refund policies.

    Launchround does not receive or store your complete payment card information when purchases are processed directly by an app store.

    Except where required by applicable law or otherwise stated by the applicable payment provider, payments are non-refundable.

    Requests for refunds for purchases processed through Apple or Google may need to be submitted directly to the applicable platform.

    Nothing in these Terms limits any mandatory consumer rights that apply to you under the laws of your country or region.

    14. Promotions

    From time to time, we may offer discounted subscriptions, introductory pricing, free trials, coupons, lifetime access, promotional pricing, or other special offers.

    Promotional offers may:

    • be available only to eligible users;
    • be limited by time, country, platform, or account;
    • have separate conditions;
    • differ from standard pricing; and
    • be changed or discontinued where permitted by law.

    If the specific terms of a promotion conflict with these Terms, the specific promotional terms will apply to that promotion.

    15. Internet and Device Requirements

    Some parts of Pencil Bible may require an active internet connection.

    You are responsible for:

    • your internet connection;
    • mobile data charges;
    • roaming charges;
    • compatible hardware;
    • sufficient device storage;
    • maintaining your device; and
    • keeping your operating system and Pencil Bible reasonably up to date.

    Some features may not function properly on unsupported, modified, jailbroken, rooted, or outdated devices.

    Launchround is not responsible for charges imposed by your internet, mobile, or telecommunications provider.

    16. Updates and Changes to the Service

    We may release updates to Pencil Bible from time to time.

    You may need to install updates to continue using certain features or the Service as a whole.

    We do not guarantee that Pencil Bible will remain compatible with every device, operating system version, or piece of hardware indefinitely.

    We may change, suspend, discontinue, replace, or restrict any portion of the Service at any time, subject to applicable law.

    17. Intellectual Property

    Pencil Bible, including its software, designs, trademarks, logos, branding, graphics, interface, original text, databases, and other materials, is owned by or licensed to Launchround and is protected by applicable intellectual property laws.

    Bible translations, publisher materials, third-party trademarks, and other third-party content remain the property of their respective owners.

    Nothing in these Terms transfers ownership of our intellectual property to you.

    18. Copyright Complaints

    We respect intellectual property rights.

    If you believe content available through Pencil Bible infringes your copyright or other intellectual property rights, please contact us with sufficient information for us to investigate the matter.

    We reserve the right to restrict or terminate access for users who repeatedly infringe intellectual property rights where appropriate.

    19. Third-Party Links

    The Service may contain links to third-party websites, services, or resources.

    We do not control and are not responsible for third-party websites or their content, policies, security, products, or services.

    Your use of third-party services is at your own risk and may be governed by separate terms.

    20. Disclaimer of Warranties

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PENCIL BIBLE AND THE SERVICE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

    LAUNCHROUND MAKES NO GUARANTEE THAT:

    • THE SERVICE WILL ALWAYS BE AVAILABLE OR UNINTERRUPTED;
    • THE SERVICE WILL BE ERROR-FREE;
    • ALL DATA WILL ALWAYS SYNCHRONIZE OR BE RECOVERABLE;
    • EVERY FEATURE WILL WORK ON EVERY DEVICE;
    • ALL BIBLE TRANSLATIONS WILL REMAIN AVAILABLE; OR
    • ALL INFORMATION OR THIRD-PARTY CONTENT WILL ALWAYS BE COMPLETE, ACCURATE, OR ERROR-FREE.

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    21. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LAUNCHROUND INC., ITS AFFILIATES, DIRECTORS, EMPLOYEES, CONTRACTORS, DEVELOPERS, PARTNERS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

    THIS INCLUDES, WITHOUT LIMITATION, LOSS OF DATA, LOSS OF USER CONTENT, LOSS OF PROFITS, LOSS OF BUSINESS, OR LOSS RESULTING FROM SERVICE INTERRUPTIONS.

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

    1. THE AMOUNT YOU PAID TO LAUNCHROUND FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
    2. US $100.

    Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these limitations will apply only to the maximum extent permitted by law.

    22. Indemnity

    To the extent permitted by applicable law, you agree to indemnify and hold harmless Launchround Inc., its affiliates, directors, employees, contractors, partners, licensors, and representatives from claims, liabilities, losses, damages, and reasonable legal expenses arising from:

    • your unlawful use of the Service;
    • your User Content;
    • your material breach of these Terms; or
    • your violation of the rights of another person.

    We reserve the right to control the defense of any matter subject to indemnification, and you agree to reasonably cooperate with us.

    23. Suspension and Termination

    You may stop using Pencil Bible at any time.

    Cancelling or deleting your Pencil Bible account does not automatically cancel a subscription purchased through Apple, Google Play, or another third-party payment provider. You remain responsible for separately cancelling any active subscription.

    We may suspend, restrict, or terminate your access to the Service if:

    • you materially violate these Terms;
    • your use creates a security or legal risk;
    • we are required to do so by law;
    • a third-party service necessary to provide the Service becomes unavailable; or
    • we discontinue the Service.

    Upon termination, your right to use the Service ends.

    Sections of these Terms that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, liability, indemnity, and dispute resolution.

    24. Governing Law and Jurisdiction

    To the extent permitted by applicable law, these Terms and any dispute arising from or relating to them or the Service will be governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

    To the extent permitted by applicable law, you agree that disputes that cannot be resolved informally will be subject to the exclusive jurisdiction of the applicable state or federal courts located in San Mateo County, California.

    Nothing in this section removes any mandatory rights or protections that you may have under the consumer protection laws of your country or region.

    25. Dispute Resolution

    Before commencing formal legal proceedings, you agree to make a reasonable attempt to resolve any dispute informally by contacting us.

    We will also make a reasonable attempt to resolve legitimate disputes informally.

    TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND LAUNCHROUND AGREE THAT CLAIMS WILL BE BROUGHT ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING.

    TO THE EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY WAIVES THE RIGHT TO A TRIAL BY JURY.

    26. App Store Terms

    When you download or purchase Pencil Bible through a third-party app marketplace, your use of that marketplace is also subject to its applicable terms and policies.

    For Apple users, the applicable Apple App Store terms and Apple's Standard End User License Agreement may also apply.

    For Android users who obtain Pencil Bible through Google Play, applicable Google Play terms and policies may also apply.

    If a mandatory requirement of an applicable app marketplace conflicts with these Terms, the mandatory marketplace requirement will apply to the extent of that conflict.

    27. Changes to These Terms

    We may update these Terms from time to time to reflect changes to Pencil Bible, our business, applicable laws, platform requirements, pricing models, or other circumstances.

    When we make changes, we will update the “Last Updated” date.

    Where required by law, we will provide additional notice of material changes.

    Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.

    28. Entire Agreement

    These Terms, together with our Privacy Policy and any additional terms expressly presented to you in connection with a specific feature, purchase, or promotion, constitute the agreement between you and Launchround regarding your use of the Service.

    These Terms replace previous versions of the Pencil Bible Terms of Service regarding the same subject matter.

    If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

    Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
